Citlalitl Pereda Gomez, commercially known as “MY BAJA INSURANCE”, with registered address for notifications at Blvd. Benito Juarez #31-11 Zona Centro, Playas de Rosarito, B.C. CP 22700, is responsible for the use and protection of your personal data. We inform you of the following:
The personal data we collect from you will be used for the following primary purposes, which are necessary for the service you request:
Quoting, processing, issuing, renewing, and canceling insurance policies (Cars, Home, Medical Expenses, etc.).
Managing service collection and billing.
Processing claims and indemnities with Insurance Companies.
IDENTITY VERIFICATION AND LEGAL COMPLIANCE: To comply with the Law on Insurance and Surety Institutions and the General Provisions referred to in Article 492 thereof (Prevention of Money Laundering and Terrorism Financing), we are legally obliged to create a client identification file.
DOCUMENT RETENTION: Keeping physical and/or digital copies of official documents that prove ownership of insured assets and the identity of the contracting party to avoid key suspension, policy cancellation, or rejection of claims by the Insurance Company.
Additionally, we will use your personal information for the following secondary purposes, which allow and facilitate us to provide you with better service:
Sending information about new products, promotions, or maturity reminders.
To carry out the purposes described in this privacy notice, we will use the following personal data and documents (certified copy):
Identification and Contact Data: Full name; Address (street, number, neighborhood, city); Phone (landline and mobile); Email; Federal Taxpayer Registry (RFC); CURP; Valid Official Identification (INE, Passport); Proof of Address (Electricity, Water, and/or Phone).
Asset and Financial Data:
Information about movable and immovable property to be insured (Description, value, characteristics);
Vehicle data to be insured: (Make, Model, #Serial/VIN, #License Plates); Vehicle photograph; Bank details (for direct debit payments); Valid driver’s license; Valid circulation card.
For Home Insurance: Identification data; Proof of Address matching the risk location or proving insurable interest; Photograph of the property.
IMPORTANT CLAUSE: Refusal to provide the aforementioned supporting documentation (Licenses, Circulation Cards, IDs, Proof of Address) will prevent “MY BAJA INSURANCE” from processing the policy issuance or claims. This will release the office from any responsibility for lack of coverage due to non-compliance with the documentation requirements mandated by Insurance Companies and the Law.
TRANSFER OF PERSONAL DATA
We inform you that your personal data is shared within and outside the country with the following individuals, companies, organizations, and authorities, other than ourselves: Insurance Companies (e.g., Qualitas, Chubb, AXA, Zurich, etc.), Competent Authorities (in legally foreseen cases), for the following purposes: risk analysis, policy issuance, claims payment, and compliance with CNSF regulations. This transfer is necessary by virtue of the insurance contract; therefore, your express consent is not required, as without it, the service cannot be provided. We commit not to sell, exchange, or rent your personal information to third parties for commercial or profit purposes. Your data is shared exclusively for the operational and contractual purposes described herein.
ARCO RIGHTS: You have the right to know what personal data we have about you, what we use it for, and the conditions of use (Access). Likewise, you have the right to request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); to have it removed from our records or databases when you consider it is not being used adequately (Cancellation); as well as to object to the use of your personal data for specific purposes (Opposition). If you do not wish your personal data to be processed for these additional purposes, you may submit a written request via email to rosaritoinsurance@gmail.com or in person at our offices located at the address indicated above, stating your intention.
LIMITATION OF USE AND DISCLOSURE OF DATA: To limit the use and disclosure of your personal information, we suggest you register in the Public Registry to Avoid Advertising (REPEP), which is managed by the Federal Consumer Protection Agency (PROFECO).
